Ask an Expert is a Big "I" Members Only resource. Members using the Big "I" University sometimes need answers to questions that they can't find in the Research Library, Classrooms or Student Lounge. Q: Under an ISO PAP, if an unlisted driver (adult child) who is not a resident of the insured's household but has regular use of a declared vehicle should have an accident, would the driver be covered for all benefits and be defended by the carrier as the insured would be in the event of a lawsuit?

 

A: The ISO PAP has no specific exclusion for this.

But, if the driver was deliberately concealed from the insurer on an application, the carrier might have a valid basis for alleging fraud, thus voiding the policy and denying the claim. It depends on the law in your state. As the agent, if you’re aware of this, you most likely have a legal and contractual obligation to advise the insurer of the situation. This could lead to a premium charge, cancellation, or nonrenewal.
